§ 32-3. Purpose, authority and jurisdiction.

  • (a)

    Under the authority of state law, the town council does hereby adopt the following regulations to hereafter control the subdivision of land within the corporate limits of the town and in the unincorporated areas lying within the extraterritorial jurisdiction of the town limits, in order to provide for the orderly development of the area and to secure adequate provision for traffic, light, air, recreation, transportation, water, drainage, sewer and other facilities.

    (b)

    Any owner of land located inside the corporate limits or within extraterritorial jurisdiction of the town wishing to subdivide such land shall submit to the town council a plan of subdivision which shall conform to the minimum requirements set forth in these regulations and conform to the town's comprehensive plan. Any owner subdividing his land into parcels of not less than five acres each for agricultural use and not involving new streets shall be exempt from these requirements.

    (c)

    No subdivision plat shall be filed or recorded, and no lot in a subdivision inside the corporate limits or within the extraterritorial jurisdiction of the town shall be improved or sold, until the plat shall have been approved by the town council. The town shall have the authority to prohibit the installation of public utilities in unapproved subdivisions and to prohibit the issuance of building permits for structures in such unimproved subdivisions.
