§ 6-127. Failure to comply with orders; interference with enforcement activities.

  • (a)

    It shall be unlawful for any person to fail or refuse to:

    (1)

    Comply with a lawful order of the building official or the commission;

    (2)

    Obstruct or interfere with the implementation of any action required by an order of the building official or the commission; or

    (3)

    Remove a posted unsafe building placard without the permission of the building official, or to enter a posted unsafe building, except for the purpose of inspection, making required repairs, or demolishing the same.

    (b)

    No person may remove or deface the notice to vacate after it is posted until the required repair, demolition, or removal is completed and a certificate of occupancy is issued under the building code.

    (c)

    A person commits an offense if, prior to the time that the owner receives notice from the town that all required corrections have been made, the person leases or causes to be leased a building or structure or portion of a building or structure that is vacant at the time that the owner receives notice from the town that the building or structure is substandard or after a notice to vacate is posted, whether or not the notice has been unlawfully removed, until the required repair is completed, inspected, and a certificate of occupancy for the building or structure is issued by the building inspector; or leases or causes to be leased a building or structure or portion of a building or structure that becomes vacant after the owner receives notice from the town that the building is substandard or after a notice to vacate is posted, whether or not the notice has been unlawfully removed, until the required repair is completed, inspected, and a certificate of occupancy for the building or structure is issued by the building inspector.
