§ 10-33. Municipal court building security fund.

  • (a)

    Fund established. The town council has created and established a municipal court building security fund pursuant to state law.

    (b)

    Fee established; assessment. The municipal court is authorized and required to assess a municipal court building security fee, as set forth in the town fee schedule, against all defendants convicted of a misdemeanor offense by the municipal court. Each misdemeanor conviction shall be subject to a separate fee assessment.

    (c)

    What constitutes conviction. For purposes of this section, a defendant is considered convicted if judgment, sentence or both are imposed on the person; the person is placed on deferred disposition; or the court defers final disposition or imposition of the judgment and sentence.

    (d)

    Collection and deposit. The municipal court clerk is authorized and required to collect the fee and to pay same to the town treasury who shall segregate the fee in the court building security fund.

    (e)

    Use of fund. The court building security fund shall be used only for the purpose of financing the purchase of security devices or services for the building housing the municipal court to the extent such purchases are permitted by state law.

    (f)

    Administration. The fund shall be administered by or under the direction of the town council.
